These Terms of Use (“Terms”) govern your access to and use of the website www.smonic.com (the “Site”), including any content, functionality, products, or services offered. By using our Site, you (“User,” “you,” or “your”) agree to be bound by these Terms and our official policies.
If you do not agree with these Terms in their entirety, you are expressly prohibited from using or accessing the Site.
1. Eligibility

1.2 If you are using the Site on behalf of a company or organization, you represent and warrant that you are authorized to bind such entity to these Terms.

2.1 To place an order, you may be required to create a User Account. You are responsible for maintaining confidentiality of your login credentials.

2.3 The Company reserves the right to suspend or terminate accounts that violate these Terms or applicable law.
3. Products and Orders
3.1 Products include books, stationery, merchandise, and digital goods listed on the Site.
3.2 Prices and availability are subject to change without notice.
3.3 In case of a Manifest Error (e.g., obvious pricing mistake), the Company reserves the right to cancel the order, even after payment confirmation.
3.4 Bulk/Wholesale Orders (100 units or more) may be subject to additional conditions, timelines, or restrictions.
3.5 Products marked as Non-returnable (NR) cannot be returned or refunded under any circumstances.
4. Payment and Taxes
4.1 All payments must be made using the payment gateways provided on the Site.
4.2 Prices are displayed in Indian Rupees (INR) and include applicable GST unless otherwise stated.
4.3 The Company is not responsible for additional fees charged by banks, card issuers, or third-party payment providers.
5. Shipping and Delivery
5.1 Orders will be shipped using our Third-party Partners (courier/logistics providers).
5.2 Delivery timelines are estimates only and may vary due to Force Majeure Events or service disruptions.
5.3 Risk of loss passes to the User upon delivery of the Product by the courier.
6. Returns, Refunds & Cancellations
6.1 Return eligibility will be clearly specified on product pages.
6.2 Digital Products and NR Products are not eligible for return or refund.
6.3 Refunds, if approved, will be processed to the original payment method within the time period specified in our Return Policy.
7. User Responsibilities
7.1 You agree not to misuse the Site by engaging in fraudulent, abusive, or unlawful activities.
7.2 You shall not copy, reproduce, resell, or exploit any portion of the Site or Products without express written consent from the Company.
7.3 Any violation may result in termination of your access and potential legal action.

10. Limitation of Liability
10.1 To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, or consequential damages arising from your use of the Site or Products.
10.2 Our total liability for any claim shall not exceed the total amount paid by you for the relevant Product.
11. Indemnification
You agree to indemnify and hold harmless the Company, its directors, employees, and affiliates against all claims, damages, liabilities, costs, or expenses arising from your breach of these Terms or violation of applicable law.
12. Force Majeure
The Company will not be held liable for delays or non-performance caused by events beyond its reasonable control, including but not limited to natural disasters, strikes, government actions, or pandemics.
13. Governing Law & Dispute Resolution
13.1 These Terms are governed by the laws of India, with exclusive jurisdiction of courts at Sonipat, Haryana.
13.2 Any disputes shall first be attempted to be resolved amicably. If unresolved, the matter will be referred to arbitration in Sonipat under the Arbitration and Conciliation Act, 1996.
14. Amendments
The Company reserves the right to modify these Terms at any time. Updates will be posted on this page with a revised “Effective Date.” Continued use of the Site after such updates constitutes acceptance.
